car accident claims

When an auto accident takes place the only way to go about it is to first ensure your safety and the safety of the passengers that are with you. Emergency services should be called if anyone has received any kind of injury and once all that has been taken care of only then you can proceed to worrying about the car. When you think you are safe from any injury and it is only the car that has received the brunt of the accident, then you can begin the process of accident claims in order to receive the proper compensation for the repair and maintenance of your car that got damaged in the accident. Accidents like this usually happen because someone was negligent enough to text their friends on their cell phone or because someone was driving under the influence of drugs or alcohol. Whatever the reason you should not worry about it so much because when the other party is at fault the police report and even the witnesses will be able to clarify that the fault was never yours.

Of course you will have to call the police immediately before you or the other driver has moved in any way so a proper report can be made in order to provide proof. You should also talk to any witnesses and take their phone numbers so they can give their testimony. Car accident claims that require the entire replacement of the car will be a little more complicated and you will have to prove that the car is indeed damaged completely and will not be able to run well with repairs. In such a case the insurance company is supposed to give you the money for the replacement of the car. But you should be careful here because insurance companies can be very conniving at times when they do not want to spend any of their money. They will try to send an adjuster your way so he or she can negotiate a deal with you that is actually less than what they actually owe you. In the case of car replacement claims they might try to get quotes from wholesale sellers and tell you that that is the money you should claim for. But remember that when you are out buying the car, you will have to pay what the dealer will add to the whole sale price in order to gain profit.

Conduct a market research and get the right quote from the dealer that sells your car instead of settling for the amount the adjuster seems to push towards you. Even when doing repairs for you car you should really consider taking the car to a shop that does work that satisfies you rather then going for some repair shop that gives the insurance company a lower quote but has bad services. This is why when an accident occur get your car towed immediately to a repair shop of your choice so you simply talk to the auto accident claims adjuster on your terms and tell them that you need sufficient repairs.

If you have been in an auto accident the involves some sort of settlement claim, one of the biggest questions that will be going through your head is, do I need a lawyer to help me out?  Lawyers can help out with many different aspects of your car accident claim, but also cost money and can result in a significant amount of your settlement being taken by the lawyer instead of going to you.  After all, the money if for you to compensate you for your injuries, why should a lawyer get a cut of it?  Unfortunately, there is no one answer to this question.  In some cases a lawyer will help you out immensely, in other cases he won’t.

The biggest advantage to having a lawyer is that he is extremely well versed in dealing with auto accident settlements.  A good personal injury lawyer will have years of experience in dealing with auto accidents and insurance companies.  If your case is long or complicated or involves a large amount of money, hiring a lawyer can make the difference between getting the money you need and getting less than you deserve.  If your case goes to trial you will definitely need an attorney to represent you.

However, if your case is not very long and doesn’t involve significant complications, hiring a lawyer becomes more of a luxury than a necessity.  If your accident is relatively minor, you may even end up getting less money if you hire an attorney than if you had actually negotiated the settlement yourself!  In smaller cases, negotiating the case yourself makes more sense because there won’t be any legal motions or other complications you can’t handle.  Even if you don’t hire an attorney, you can still use the threat of hiring one to your advantage to try to cough up a few extra dollars from your insurance company as well.
